1. Acceptance of Terms

By accessing or using Multimedium ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including but not limited to visitors, registered users, and contributors.

2. Description of Service

Multimedium is a social media management platform that enables users to manage multiple social media accounts and channels from a single interface. The Service allows users to connect, monitor, and interact with various social media platforms through our unified dashboard.

3. User Accounts and Registration

3.1 Account Creation: To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3.3 Age Requirement: You must be at least 13 years of age to use this Service. If you are under 18, you must have permission from a parent or legal guardian.

4. Third-Party Platform Connections

4.1 Authorization: By connecting third-party social media accounts to Multimedium, you authorize us to access and use your accounts in accordance with the permissions you grant.

4.2 Third-Party Terms: Your use of connected third-party platforms remains subject to their respective terms of service and privacy policies. You are solely responsible for compliance with such terms.

4.3 Credentials Storage: You acknowledge that we may store access tokens and credentials necessary to maintain your third-party platform connections. We will handle these credentials in accordance with our Privacy Policy.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Transmit any harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
  • Use any automated means to access the Service for any purpose without our express written permission
  • Engage in any activity that could damage, disable, overburden, or impair the Service
  • Violate the terms of service of any connected third-party platforms

6. Content and Intellectual Property

8. Subscription and Payment Terms

9. Termination

9.1 By You: You may terminate your account at any time by contacting us or using the account deletion feature in the Service.

9.2 By Us: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other reason.

9.3 Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated data. Provisions that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable. We do not warrant that the quality of any products, services, information, or other material obtained through the Service will meet your expectations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MULTIMEDIUM, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST TWELVE (12) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Multimedium, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party, including any connected third-party platforms; or (d) any content you submit, post, or transmit through the Service.

13. Dispute Resolution

13.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Multimedium is registered, without regard to its conflict of law provisions.

13.2 Arbitration: Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except as otherwise provided herein. The arbitration shall take place in the jurisdiction where Multimedium is registered.

13.3 Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

15. General Provisions

15.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Multimedium regarding the Service.

15.2 Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

15.3 Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
